TENNESSEE: Jury Rejects "My Daughter Saw Gay Porn!" Lawsuit

You may recall my 2008 post about former Big Brother contestant Kent Blackwelder, who filed a $4M lawsuit against Specialty Publications (a distributor of Titan Media) because his daughter "accidentally opened" one of their promo packages which was mysteriously sent to his house. Blackwelder's suit claimed that a five-second viewing of naked gay men caused his daughter to need counseling for a sudden fear of being kidnapped. (By Titan porn stars, one presumes.) Yesterday a Tennessee jury rejected the lawsuit as nonsense.

The four-woman, four-man civil jury rejected Powell father Kent Blackwelder's bid to hold California firm Specialty Publications Inc. financially responsible for his then-12-year-old daughter's glimpse of a racy advertisement for the gay magazine "Freshmen" in May 2007. "Do I wish it hadn't happened?" First Amendment attorney Richard Hollow asked jurors in closing arguments. "Yes. Do I believe children should be protected? You bet. But it's not up to everybody else to take care of our children." Blackwelder, who appeared on the "Big Brother" reality television show in 2001, wound up on the mailing list after his name and address were used to enter an online contest for a free trip to a "gay-friendly" locale. His daughter later opened a direct-mail brochure with photos of nude men. He sued, claiming the mailer was unsolicited, violated postal regulations and caused his daughter distress. But Hollow countered that the publisher, which has since folded, followed regulations. The mailing was sealed with a "wafer tab" and bore a warning label.

Blackwelder says he was put on the mailing list as an act of vengeance for a different lawsuit claiming he'd been fired from his job because he is white.

CALIFORNIA: State OSHA Fines Gay Porn Studio For Allowing Barebacking

The California division of OSHA has fined the gay porn studio Treasure Island Media for workplace practices that exposed employees to potentially infectious agents such as semen. The company is appealing the fines, which total over $21,000 for three separate citations. Lyla Katz reports at Xbiz:

"On Nov. 5, 2009, Treasure Island Media had failed to write or otherwise establish, implement and maintain an effective exposure control plan,” the 23-page investigation report said. “Employees were exposed to semen and other potentially infectious materials, due to work activities during filming and set cleaning.” The second serious citation said, “Treasure Island Media does not observe universal precautions during the production of their films. They have not instituted engineering and work practices controls to eliminate or minimize contact with blood and semen, including, but not limited to, the use of barrier protection such as condoms.”

Treasure Island Media's general manager Matt Mason told XBIZ that the company has cooperated with the Cal/OSHA investigation and administrative process. "We have appealed the citations and participated in the informal conference process and expect to take the matter to a hearing in 2011 with an administrative law judge," Mason said. Treasure Island Media has recently signed HIV-positive performer James Roscoe and has been promoting scenes with other HIV-positive performers.

A spokesman for CAL/OSHA said the fines did not arise from the studio's practice of employing HIV-positive performers. "Anybody may be infected, therefore you have to treat everybody's blood and other potential infectious materials [such as semen] as though it can be infectious."

Gay Porn Company Sues BitTorrent Users

As part of the industry's continuing crackdown on piracy, gay porn outfit Lucas Entertainment has filed lawsuits against 53 users of the peer-to-peer file-swapping network BitTorrent. Lucas is asking the users' ISPs to disclose their names and addresses.

The time between the alleged infringement and the filing of the federal lawsuit was amazingly short: three or four days. The infringements were detected on August 5-6, and the Lucas lawsuit was filed on August 9. In addition, the company has already asked the judge to force ISPs to respond to subpoenas in 15 days or less. Clearly, speed is an issue. The suit also claims the copyright infringement here was "intentional," which opens the door to much higher statutory damages that top out at $150,000 per infringement. More defendants will be added to the case before it's over. Lucas suggests that "information obtained in discovery will lead to the identification of additional infringing parties," and its ongoing "monitoring" may contribute more names, too. These sorts of schemes generally rely more on settlement letters than actual trials to collect the cash, however; something that may be doubly true when gay porn is the issue.

JMG tipper Davecool notes that the final sentence of the story implies that Lucas feels that "gay porn shame" may force faster settlements.

No Bareback Porn On Sale At IML

The International Mr. Leather convention has followed through on their vow to ban the selling of barebacking porn at their vendor mart. Via Chicagoist:

“For many years, our organization has always preached the importance of safe- sex,” explains [IML coordinator RJ] Chaffin. “It has been on the lips of many people, [the fact that] we speak out on safe-sex, but allow vendors to promote bareback videos. The time has come for us to take a stand on the issue. It affected about three of our vendors and in fact, most vendors were pleased to see us take action on this matter. I would say for every negative e-mail we’ve received, we’ve received 15 supportive emails and letters,” says Chaffin, who has received calls and emails from organizers of similar events to gauge the reaction of attendees to the new policy. “We need younger people to realize that barebacking is not cool and very dangerous.”

The event continues through tomorrow.

Former barebacking porn star Brent Corrigan has amended his unsafe ways and is apologizing to the to the gay male community by participating in a safer sex campaign conducted by the Washington-based DC FUK!T. Via press release:

DC FUK!T, a Washington D.C. based safer sex advocacy group, released its latest "How to Put on a Condom" video, staring adult performer, Brent Corrigan. Corrigan volunteered his time and "sizable talent" for the group's edgy condom campaign, just as porn icon Matthew Rush did in a similar "how to" video released by the group this past fall. Said one of the group's co-founders: "Although when Mr. Corrigan first entered the adult industry as a teen, he performed in bareback porn films, he has long since become an advocate for safer sex and has very publicly apologized for his past appearances in films depicting high risk and unsafe sexual practices. We believe that Brent's ability to learn from his professional mistakes years ago and change his behavior are what now make him a great spokesperson and role model for safer sex at a time when both bareback porn and HIV are unfortunately making a comeback."
